Terms of Use and Data Handling

Article 1 (Scope)

1. These Terms apply to everyone who uses the Tool, whether or not they hold a 4S App account.
2. The Tool is a companion service to the 4S App event platform (4s.link), but use of the Tool is governed by these Terms. Matters not covered here are governed by applicable law and by the notices we post on the Tool.
3. When you sign in to the 4S App to use “Use my 4S profile photo”, or when an Organizer signs in to the 4S App to use the admin screens, that use of the 4S App (including account management and the handling of your registered information) is additionally governed by the 4S App Terms of Service and Privacy Policy (the Japanese originals at 4s.link/ja/company/terms/ and 4s.link/ja/company/privacypolicy/ prevail; the English pages are translations). Where they differ, these Terms prevail for use of the Tool.
4. Campaign-specific notices shown on the Tool form part of these Terms.

Article 2 (Definitions)

• “Campaign” — the set of badge designs and the public page that an Organizer sets up on the Tool for one event.
• “Organizer” — an event organizer, or a person working with one, who has been invited by us to use the admin screens.
• “User” — anyone who creates a badge on a Campaign page.
• “Template” — the background and foreground design images registered to a Campaign.
• “Generated Image” — the image composed on the User’s own device from the User’s photo and a Template.
• “Post Text” — the suggested wording prepared for each Campaign for posting on social media.

Article 3 (Conditions of Use)

1. Creating a badge does not require signing in. Signing in to the 4S App is required only if you choose to use the profile photo registered there. Use of the admin screens is governed by Article 8.
2. If you are a minor, please use the Tool with the consent of a parent or guardian.
3. You are responsible for the device, browser, and network connection needed to use the Tool.

Article 4 (Photos and Generated Images)

1. A photo you choose from your device is processed only inside your browser. It is never sent to our servers.
2. The Generated Image is also created on your device. We do not receive or store it. Whether you save it to your device or post it on social media is entirely your choice and action.
3. If you choose “Use my 4S profile photo”, our server fetches the photo registered in the 4S App from the 4S App’s image server and passes it straight to your browser. It is not stored on our server. The user ID and e-mail address received from the 4S App at sign-in are used only to confirm that it is you who signed in, and are not stored.

Article 5 (Rights in Generated Images and Permitted Use)

1. Copyright and all other rights in Templates, Post Text, and the Tool belong to us or to the Organizer.
2. You may save the Generated Image, post it on social media, and share it with others for the purpose of announcing your participation in the event.
3. You may not:
   • copy, modify, or reuse a Template outside the Tool;
   • use the Generated Image for advertising, sale, or any other commercial purpose unrelated to the Campaign’s event.
4. Rights in the photo you choose remain with you (or the rights holder of the photo). We do not ask you for any licence to the photo.
5. If you make the Generated Image public on social media, we and the Organizer may feature that post through the functions the platform itself provides (repost, quote, embed), or by placing it on our or the Organizer’s website, event materials, or announcements. If you do not want your post featured, contact us through Article 10 and we will stop promptly.

Article 6 (Your Responsibilities)

1. You are responsible for obtaining the consent of anyone who appears in the photo, and for checking copyright and any other third-party rights in it.
2. You are responsible for posting the Generated Image and for whatever follows from it, including how the social media platform treats the post.

Article 7 (Prohibited Conduct)

You must not:

• use another person’s photo without that person’s consent;
• impersonate another person;
• misrepresent your role in the event (such as speaker, organizer, or sponsor);
• infringe anyone’s copyright, portrait rights, privacy, reputation, or other rights;
• create or post images that are discriminatory, obscene, violent, antisocial, or otherwise offensive to others;
• place excessive load on the Tool or the 4S App, access the Tool by automated means, or manipulate its counters;
• reverse-engineer the Tool or extract Template images;
• use the Tool for advertising, solicitation, or sales without our permission;
• violate any law or public order and morals;
• do anything else we reasonably consider inappropriate.

If we consider that conduct falls under this Article, we may suspend the Campaign, ask you to stop using the Generated Image, or take other measures we consider necessary.

Article 8 (Organizers)

1. The admin screens are available only to people invited by us or by an Organizer with invitation rights, after signing in to the 4S App. An Organizer can operate only the Campaigns within the scope of their invitation.
2. An Organizer who registers content warrants that it holds the rights needed for the Templates, Post Text, event names, and other content it registers to a Campaign, and that this content does not infringe third-party rights.
3. The Organizer grants us permission to store, reproduce, and deliver Templates and other registered content to the extent needed to provide the Tool.
4. The Organizer is responsible for the content of its Campaigns and for planning and running the event. We take part as the technology provider.
5. The metrics an Organizer can view in the admin screens are aggregate figures only. They do not include information that identifies an individual User. The member list in the admin screens does show the e-mail address, role, and assigned Campaigns of other Organizers whose scope overlaps with yours.
6. We may suspend or delete a Campaign without prior notice to the Organizer in the event of a breach of these Terms, a report of rights infringement, or where we otherwise consider it necessary.

Article 9 (Data We Collect and Why)

1. We collect the following data through the Tool.

2. The only cookies the Tool uses are three related to signing in to the 4S App: one for fetching your photo (1 hour), one for the admin sign-in (12 hours), and a temporary one during the sign-in process (10 minutes). None of them is used for advertising or behavioural tracking.
3. We do not use Google Analytics or any other analytics service, nor any advertising identifier, in the Tool.
4. Data sent to other parties and storage: when you view or use the Tool, your device sends data as follows.

   Template image files are kept in Vercel Inc.’s storage, and counts, de-duplication and rate-limit records, Campaign settings, Organizer data, and the operation history are kept in databases provided by Upstash, Inc., in each case via our server. Providing data to Vercel Inc. and Upstash, Inc. is an entrustment within the scope needed to achieve our purposes of use, not a provision to third parties.
5. We do not provide the data we collect to third parties except where required by law or entrusted to the providers named in the previous paragraph. What Organizers receive about Users’ activity is aggregate figures only.
6. The handling of your 4S App account information itself is governed by the 4S App Privacy Policy.
7. Users and Organizers may ask us to notify the purpose of use of, disclose, correct, add to, delete, suspend the use of, erase, or stop providing to third parties their personal data held by us. Please e-mail the contact in Article 10. To confirm your identity we may ask that you write from your registered e-mail address. No fee is charged. If you used the Tool without signing in, we hold no data that identifies you, so there is nothing to disclose (as the table in paragraph 1 shows, the counting identifier stays in your own browser and the IP address record expires within 2 minutes).

Article 10 (Reporting Misuse and Contact)

1. If you become aware of misuse of the Tool, for example your photo being used without your consent or a suspected impersonation, please contact us atcontact@4s.link (4S Inc.). Please put “4S Banner” in the subject line and include the URL of the post concerned and your relationship to the photo.
2. We will review the report and take measures such as suspending the Campaign or contacting the Organizer. Because we do not operate the social media platforms, removing the post itself may require the procedure set by the platform concerned.

Article 11 (Changes, Suspension, and Termination of the Tool)

1. We may change or suspend all or part of the Tool without prior notice for maintenance, changes in specification, force majeure, or other reasons. If we terminate the Tool itself, we will give prior notice by posting on this page.
2. Each Campaign has a publication period. The generation screen is not provided outside that period.
3. Generated Images already saved to your device are not affected by suspension or termination of the Tool.

Article 12 (Disclaimer)

1. The Tool is provided “as is”. We make no warranty as to fitness for a particular purpose, completeness, continuity, or otherwise.
2. If a User or Organizer suffers damage through use of the Tool, we will compensate that damage where it is caused by our wilful misconduct or gross negligence. Where it is caused by our ordinary negligence, we will compensate only ordinary and direct damage actually incurred.
3. For the content, changes, or cancellation of the event itself, please contact the Organizer.
4. Posting on social media is subject to the platform’s own terms. We are not responsible for the consequences of a post.

Article 13 (Changes to These Terms)

We may change these Terms when laws change, the Tool’s specifications change, or it otherwise becomes necessary. Revised Terms take effect five days after they are posted on this page. Using the Tool after the effective date constitutes acceptance of the revised Terms.

Article 14 (Severability)

If any provision of these Terms, or part of one, is held invalid or unenforceable under applicable law, the remaining provisions and the remainder of that provision continue in full force. We and the User will endeavour to give the invalid or unenforceable part effect to the extent consistent with the purpose of these Terms.

Article 15 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute relating to these Terms.

Article 16 (Language)

These Terms are written in Japanese. The English version is a courtesy translation; if the two differ, the Japanese version prevails.
